Welcome to the ZONA Business Panel
1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the ZONA Business Panel (“ZONA Pro”), a web-based CRM platform for venues and promoters participating in the ZONA ecosystem. By accessing or using ZONA Pro, you agree to comply with these Terms.
2. Services Provided
ZONA Pro offers tools and features that allow registered venues and promoters to manage their activities on the ZONA platform, including:
- Business Details Management: Add, edit, and manage your venue’s details, including descriptions, photos, and contact information.
- Event Management: Add, edit, and manage events hosted at your venue.
- Guest List Creation: Create and manage guest lists for your events, including approval or denial of guest requests and interaction with guests via chat.
- Ticket Sales: Sell and manage event tickets through the ZONA platform.
- Bottle Service Management: List and sell bottle service packages, including real-time updates on availability and “Last Call” special offers.
- Digital Wallet Offers: Create and manage offers redeemable through the ZONA Vault (digital wallet), such as free drinks or special promotions.
- Follower Insights: Track and review followers who have favorited your venue or saved your events for improved engagement.
- Analytics and Reporting: Access insights on user engagement, ticket sales, bottle service bookings, and offer redemptions.
3. Venue Responsibilities
- Accurate Information: Venues are responsible for ensuring all information about their business, events, offers, and services is accurate and up-to-date.
- Compliance with Local Laws: Venues must comply with all applicable laws, including age restrictions and alcohol service regulations.
- Professional Conduct: Venues must maintain a professional standard of conduct with users. Any inappropriate behavior or repeated user complaints may result in suspension or termination from ZONA Pro.
4. Fees and Payment Structure
The following fees apply to services offered through ZONA Pro:
- Ticket Sales: A processing fee is applied to each ticket sold through the ZONA platform.
- Bottle Service: ZONA charges a 10% fee on all bottle service bookings, whether regular or Last Call. This 10% fee is collected at the time of booking as a deposit from the user and is paid directly to ZONA. Venues are responsible for collecting the remaining balance (including taxes, gratuity, and additional fees) directly from the user at the venue.
- Offers: There is no charge for creating and posting offers in the ZONA Vault (digital wallet).
- Guest List: A $99 fee per guest list is charged to open a guest list and enable chat functionality for user interactions.
ZONA reserves the right to adjust these fees with prior notice.
5. Bottle Service Terms for Venues
- Pricing and Availability: Venues are responsible for setting accurate bottle prices and ensuring availability as listed on the ZONA platform.
- Payment Collection: When users book bottle service through ZONA, they pay only a 10% deposit (including tax) at the time of booking. This deposit is paid to ZONA. The remaining balance, including taxes, gratuity, and any additional fees, must be paid directly to the venue at the time of the event.
- Last Call Offers: Venues can opt to offer last-minute bottle service deals through the “Last Call” feature. These bookings are subject to the same 10% fee as regular bottle service.
- Cancellations: Venues must promptly inform ZONA if they are unable to honor a bottle service booking. If the cancellation is venue-initiated, the user will receive a refund of their deposit, and the venue may face account review or penalties for repeated cancellations.
6. Cancellation and Refund Policy
- User-Initiated Refunds: Refunds to users are only processed in the event of a venue cancellation or if the venue cannot accommodate the booking due to capacity limitations.
- Dispute Resolution: Venues must cooperate with ZONA in resolving user disputes related to bookings, cancellations, or service issues.
- Limitation of Liability
ZONA provides the Business Panel as a platform for managing business operations but assumes no liability for:
- Disputes or disagreements between venues and users.
- Errors in pricing or availability provided by the venue.
- Operational issues or incidents occurring at the venue.
- Loss of revenue due to technical errors, cancellations, or user behavior.
- Indemnification
Venues agree to indemnify and hold harmless ZONA, its affiliates, and employees from any claims, damages, or expenses arising from the venue’s use of ZONA Pro, including but not limited to legal violations, inaccurate information, and user disputes.
9. Changes to Terms
ZONA reserves the right to modify these Terms at any time. Updated Terms will be posted within ZONA Pro and will be effective immediately upon posting. Continued use of ZONA Pro after changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Miami-Dade County, Florida.
